These Terms of Service ("Terms") govern your use of the Eagle Flight Simulator Club website at https://eagleflightsimclub.com and the simulator rental services we provide at our facility in Ronkonkoma, New York. By using our website, booking a session, or visiting our facility, you agree to these Terms.

Please read them carefully. If you do not agree, please do not use the site or our services.

1. Who we are

Eagle Flight Simulator Club ("Eagle FSC," "we," "us," or "our") operates a flight simulator rental facility at:

2. We are not a flight school

This is important and worth stating up front: Eagle FSC rents simulator time only. We are not a flight school under any definition.

• We do not provide flight instruction.
• We do not employ certified flight instructors (CFIs) acting in that capacity during your session.
• We do not sign logbooks, issue endorsements, or certify training events.
• We do not prepare you for any FAA checkride, written exam, or rating.

Whether time spent on our simulator counts toward any specific FAA requirement depends entirely on your rating, your situation, and current regulations. It is your responsibility to verify with current FAA regulations and, if applicable, your own flight instructor before logging time. We make no representations about loggability.

3. Eligibility

You must be at least 18 years old to enter into a booking, membership, or payment agreement with Eagle FSC. Minors under 18 are welcome to use the simulator only when accompanied by a parent or legal guardian, who books the session, signs all paperwork, and assumes responsibility on the minor's behalf.

By booking or paying, you represent that the information you provide is accurate and that you have the legal authority to do so.

4. Bookings, sessions, and walk-ins

Booking

You can reserve simulator time through our online scheduler, by phone, or in person. Bookings are confirmed only when you receive a confirmation from us — adding a slot to the scheduler does not by itself guarantee the time. Walk-ins are welcome subject to availability, but advance booking is strongly recommended.

Arrival and check-in

Please arrive a few minutes before your scheduled start time. Sessions begin and end at the booked times — late arrival shortens your session rather than extending it, since other flyers may be scheduled after you.

Cancellations and no-shows

• Cancellations made at least 24 hours before your scheduled session are eligible for a refund or rescheduling at no charge.
• Cancellations made within 24 hours may be charged the full session fee at our discretion.
• No-shows are charged the full session fee.
• If we need to cancel a session for any reason — equipment issues, weather, staff availability, etc. — we will reschedule at no cost or refund you in full.

5. Pricing and payment

Current pricing is published on our booking page. Prices are quoted in U.S. dollars and exclude any applicable taxes. We accept major credit cards on-site and through our online payment processor.

We may update pricing at any time. Changes do not affect bookings already confirmed at the prior price.

Block rate packages

Pre-paid block-rate hours (such as the 10-hour package) are non-refundable once purchased but can be used at any time, do not expire, and are transferable to another named user with our written consent.

6. Premium Membership

Premium Membership is a recurring monthly subscription. By signing up, you authorize us to charge your payment method the published monthly fee until you cancel.

• Cancel anytime. You can cancel by phone, email, or in person. Cancellation takes effect at the end of the current billing cycle — we do not pro-rate partial months.
• No refunds are issued for unused membership benefits within a billing cycle.
• Member benefits (priority booking, member pricing, event access, member-only nights) are provided as described on the membership page and may be modified with reasonable notice.
• Failed payments. If a payment fails, we will attempt to contact you. Membership benefits are paused until the account is brought current, and we may cancel the membership if payment is not resolved within a reasonable time.

7. Conduct at our facility

Our simulator is a sophisticated piece of equipment in a shared community space. While at our facility, you agree to:

• Follow all instructions from Eagle FSC staff
• Treat the simulator, controls, displays, and surrounding equipment with care
• Refrain from food, drink, or smoking inside the simulator
• Not be under the influence of alcohol or any substance that impairs your ability to operate equipment safely
• Treat staff, members, and other visitors with respect

We reserve the right to end a session, refuse service, or revoke membership — with or without refund — for any conduct that endangers people, damages equipment, or disrupts the experience for others.

8. Damage to equipment

You are responsible for damage to our simulator or facility caused by your willful misconduct, gross negligence, or violation of staff instructions. Normal wear and tear from proper use of the equipment is on us.

9. Assumption of risk and liability waiver

Operating a flight simulator can involve physical motion, sustained focus, visual stimulation, and audio effects. A small number of people experience simulator sickness, fatigue, eyestrain, or — very rarely — photosensitive reactions to certain visuals. If you have a heart condition, a history of seizures, vertigo, severe motion sensitivity, or any other condition that could make these effects unsafe for you, please consult your physician before booking.

By using our simulator, you acknowledge these risks and agree to use the equipment at your own risk. Before your first session, you will be asked to sign a separate liability release. The terms of that signed release control over anything in this section if there is a conflict.

10. Use of the website

You agree to use this website only for lawful purposes and not to:

• Interfere with the normal operation of the site or its booking system
• Attempt to gain unauthorized access to any portion of the site, our servers, or any related systems
• Submit false or misleading information through any form on the site
• Scrape, harvest, or republish content from the site without our written permission
• Use the site to transmit spam, malicious code, or harassment

11. Intellectual property

All content on this website — including the Eagle Flight Simulator Club name, logo, photographs, videos, and written copy — is owned by Eagle FSC or used with permission, and is protected by copyright and trademark law. You may view and share links to our public pages freely. Any other use, including reproduction, modification, or commercial use, requires our prior written permission.

Some product names referenced on the site (such as Real Sim Gear, Garmin G1000, and Cirrus) are trademarks of their respective owners. We use them only to describe our equipment accurately and claim no affiliation, sponsorship, or endorsement by those manufacturers.

12. Photography and recording

From time to time we may photograph or record activity at our facility — for example, during events or member nights — for use in promotional materials, social media, or our website. If you do not wish to be photographed, please let our staff know and we will accommodate the request. You may also ask us to remove an existing image of you from our public materials by contacting us.

13. Third-party links and services

Our website may link to third-party services — for example, our online booking platform, payment processor, mapping services, or social media. We are not responsible for the content, terms, or privacy practices of those third parties. Your use of them is governed by their own agreements.

14. Disclaimers

The website and our services are provided on an "as is" and "as available" basis. To the fullest extent permitted by law, Eagle FSC disclaims all warranties — express or implied — including warranties of merchantability, fitness for a particular purpose, and non-infringement.

We do not warrant that the website will be uninterrupted, error-free, or free of harmful components, that any errors will be corrected, or that the simulator will be available at any specific time. Equipment occasionally requires maintenance, and we reserve the right to take it offline as needed.

15. Limitation of liability

To the fullest extent permitted by law, Eagle FSC and its owners, employees, and agents are not liable for any indirect, incidental, special, consequential, or punitive damages — including lost profits, lost data, or lost opportunities — arising out of or related to your use of the website or our services.

Our total aggregate liability for any claim arising out of or related to these Terms or our services will not exceed the greater of (a) the amount you paid us in the twelve months preceding the claim, or (b) one hundred dollars ($100).

Some jurisdictions do not allow the exclusion or limitation of certain damages, so some of these limitations may not apply to you. Nothing in these Terms limits liability that cannot be limited as a matter of law.

16. Indemnification

You agree to indemnify and hold harmless Eagle FSC and its owners, employees, and agents from any claim, loss, or expense (including reasonable attorneys' fees) arising out of (a) your violation of these Terms, (b) your misuse of the website or facility, or (c) your violation of any law or third-party right.

17. Governing law and disputes

These Terms are governed by the laws of the State of New York, without regard to its conflict-of-laws principles. Any dispute arising out of or related to these Terms or our services will be brought exclusively in the state or federal courts located in Suffolk County, New York, and you consent to personal jurisdiction in those courts.

Before filing a formal claim, we ask that you contact us first — most issues can be resolved with a phone call.

18. Changes to these Terms

We may update these Terms from time to time. When we do, we will revise the "Last updated" date at the top of this page. Material changes will be communicated to active members by email where appropriate. Your continued use of the website or services after a change takes effect means you accept the revised Terms.

19. Severability and entire agreement

If any provision of these Terms is found unenforceable, the remaining provisions stay in effect. These Terms, together with our Privacy Policy, our Accessibility Statement, and any liability release you sign at the facility, make up the entire agreement between you and Eagle FSC regarding the website and our services.
